This Professional Practice Note provides interim guidance on the determination of land under Part 2A of the Environmental Protection Act 1990 as “contaminated land” due to unacceptable risks to human health. It is intended for use by local authority officers responsible for contaminated land matters

Specifically, it addresses the decision on whether an intake of, or other direct contact with, chemicals or other substances (but not radioactive materials) in, on or under the land represents an “unacceptable intake”.

The aim of the Note is to outline what options are currently available to local authorities in making the decisions required as part of the determination process
