Part I of the Environmental Protection Act 1990 introduced the responsibility for local air pollution control to all local authorities in England and Wales. This Act and subordinate legislation effectively created two lists of processes which are subject to Local Air Pollution Control (LAPC) and which require prior authorisations to operate. Part A processes are regulated by the Environment Agency and Part B processes are regulated by local authorities.
The aim of this guide is to assist local authorities in meeting their responsibilities under the legislation and in developing a consistent approach to regulation across the country.
