Summary

This protocol sets out the interrelationship between the two most important pieces of legislation relating to fire safety in homes, the Housing Act 2004 and the Regulatory Reform (Fire Safety) Order 2005. It seeks to promote collaborative working arrangements between Local Housing Authorities and Fire and Rescue Authorities.

To promote the efficient use of resources, the protocol identifies discrete areas of inspection and enforcement, appropriate review and monitoring arrangements and provides for urgent or complex requests for assistance from either party. It seeks to provide all parties, as far as is reasonably practical, with a measure of confidence that they are discharging their respective duties under legislation.

It has been produced jointly by Chief Fire Officers Association, the National HMO Network, Lacors, the CIEH and the National Landlords Association.

In August 2010, the working group which drew up the protocol was reconvened to review the protocol in the light of feedback and experience over the three years since it was published. The Group found that the protocol had been well received by LHAs and FRAs. However there was a need for written clarification on a few specific points. A further document was therefore produced offering this clarification.
